01ABOUT THE APPLICATION

FinGames is an educational and training application designed to help users develop skills and knowledge related to areas such as:

• financial mathematics;
• mental calculation;
• logic and quantitative reasoning;
• financial markets;
• macroeconomics and geopolitics;
• financial products;
• the financial industry;
• programming and coding;
• technical and financial interview preparation;
• other educational topics related to finance and quantitative disciplines.

FinGames may include quizzes, exercises, challenges, scores, statistics, rankings, streaks, achievements, experience points (“XP”), performance indicators, and other gamification features.

FinGames is provided primarily for educational, informational, and training purposes.

02NOT FINANCIAL OR INVESTMENT ADVICE

FinGames does not provide financial, investment, trading, legal, tax, accounting, or professional advice.

Nothing available through the application should be interpreted as:

• a recommendation to buy, sell, or hold any financial instrument;
• investment advice;
• a trading signal;
• a solicitation or offer relating to any financial product;
• portfolio management advice;
• a prediction of future market performance.

Any examples involving financial instruments, companies, securities, currencies, derivatives, commodities, interest rates, market scenarios, or economic events are provided solely for educational purposes.

You remain solely responsible for any financial or investment decisions you make.

You should consult an appropriately qualified professional before making investment, financial, tax, or legal decisions.

03NO GUARANTEE OF ACCURACY

We aim to provide high-quality and accurate educational content.

However, financial markets, economic data, laws, regulations, industry practices, technologies, and programming tools may change over time.

We therefore do not guarantee that all information available through FinGames is at all times:

• complete;
• accurate;
• error-free;
• current;
• suitable for a particular purpose.

Some questions or explanations may simplify real-world concepts for educational purposes.

04ELIGIBILITY

You must be at least 16 years old, or meet the minimum legal age required in your country to use the application independently.

If you are below the age required to enter into these Terms independently, you may only use FinGames with the consent of a parent or legal guardian where applicable.

By using FinGames, you confirm that you are legally permitted to do so.

05NO ACCOUNT, AND WHERE YOUR DATA LIVES

FinGames does not require you to create an account, and does not ask for an email address or a password. The first name you may enter is optional and stays on your device.

Your progress, your scores, your answers and your settings are stored only on your device. Only the data needed to manage your subscription is processed outside it, by our subscription provider, as described in our Privacy Policy.

Two consequences follow, and you should know both:

• we cannot recover your progress if you delete the application, change device, or reset your device;
• we cannot access, read, or restore your progress, because it never reaches us.

Your subscription is held by the store you purchased it from, not by us, and can be restored through that store on a new device.

If a future version introduces optional accounts, these Terms will be updated before that feature is made available.

06SCORES, XP, RANKS AND PERFORMANCE DATA

FinGames may provide gamification and performance features including:

• scores;
• accuracy rates;
• response times;
• XP;
• streaks;
• personal records;
• achievements;
• statistics;
• rankings;
• levels or professional-style ranks such as Trainee, Analyst, Associate, VP, Director, and MD.

These features exist exclusively within the FinGames application.

A FinGames rank does not represent:

• an academic qualification;
• a professional certification;
• employment experience;
• regulatory authorization;
• a professional title;
• competence recognized by any bank, financial institution, university, employer, regulator, or other third party.

For example, achieving the rank of “Managing Director” or “MD” within FinGames does not imply that the user holds or is qualified to hold such a professional position.

Scores and performance indicators should be interpreted solely as in-app measures of performance.

07EDUCATIONAL CONTENT

Questions, answers, explanations, exercises, challenges, illustrations, code examples, market scenarios, and other educational materials available through FinGames are intended to support learning and practice.

We may periodically:

• add new content;
• remove content;
• modify questions;
• update explanations;
• adjust difficulty levels;
• change scoring mechanisms;
• modify XP calculations;
• modify rank requirements.

We may make such changes without prior notice where reasonably necessary to improve the service.

08INTELLECTUAL PROPERTY

Unless otherwise stated, the FinGames application and its content are owned by or licensed to FinGames — Aaron ADA (EI).

This includes, where applicable:

• the FinGames name and branding;
• FinMath, FinMind and FinCode branding;
• logos;
• interface designs;
• graphics;
• illustrations;
• questions;
• explanations;
• databases;
• software;
• source code;
• algorithms;
• animations;
• sounds;
• text;
• educational structures;
• ranking systems;
• original content.

These materials may be protected by copyright, trademark, database rights, and other intellectual property laws.

Your use of FinGames does not transfer any ownership rights to you.

09LIMITED LICENSE

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use FinGames for personal and lawful purposes in accordance with these Terms.

Unless expressly authorized by us, you may not:

• copy substantial portions of the application or its content;
• reproduce or redistribute our question database;
• sell or commercially exploit our content;
• reverse engineer the application except where permitted by law;
• scrape or automatically extract content;
• bypass technical protections;
• create unauthorized derivative products based on FinGames content;
• use automated systems, bots, or scripts to manipulate scores, XP, rankings, or statistics.

10ACCEPTABLE USE

You agree not to use FinGames in any manner that:

• violates applicable law;
• interferes with the operation or security of the application;
• attempts to gain unauthorized access to systems or accounts;
• introduces malicious software;
• exploits vulnerabilities;
• manipulates ranking or scoring systems;
• impersonates another user;
• infringes intellectual property rights;
• abuses, threatens, or harms other users where social features are available.

We may restrict or terminate access where these rules are violated.

11THIRD-PARTY INFORMATION AND SERVICES

FinGames may display or refer to information originating from third-party sources, including financial, economic, technological, or market-related information.

FinGames may also contain links to external websites or services.

We do not control third-party websites or services and are not responsible for:

• their content;
• accuracy;
• availability;
• security;
• privacy practices;
• products or services.

Access to third-party services is subject to their own terms and policies.

The names of banks, investment firms, companies, schools and other organisations appear in FinGames only to refer to them — for example, as firms you may be preparing for. FinGames is not affiliated with, sponsored by or endorsed by any of them, and their names and trademarks belong to their respective owners.

12MARKET AND CURRENT-EVENT CONTENT

Certain FinGames content may relate to financial markets, companies, economic indicators, geopolitical events, central banks, financial institutions, or current events.

Such information may become outdated quickly.

Unless specifically indicated otherwise, users should not assume that FinGames provides real-time market data.

FinGames should not be relied upon as a primary source for executing financial transactions or making investment decisions.

13PROGRAMMING AND CODE CONTENT

FinCode may include source code, programming questions, algorithms, debugging exercises, or technical examples.

Code provided through FinGames is primarily educational.

We do not guarantee that code examples are:

• suitable for production environments;
• secure;
• optimized;
• compatible with every software environment;
• free from errors.

Users are responsible for reviewing and testing any code before using it outside FinGames.

14SUBSCRIPTIONS AND PURCHASES

Certain features of FinGames may be offered free of charge, while other features may require payment or subscription.

The LEARN, PRACTICE and EVALUATE sections are available to paying subscribers only. Difficulty levels above the easiest one require an active subscription.

Subscriptions renew automatically at the end of each period, at the price displayed at the time of purchase, unless cancelled at least 24 hours before the end of the current period.

Cancelling stops the next renewal; it does not shorten or refund the period already paid for, unless applicable law provides otherwise.

You can cancel at any time from your account settings in the App Store or Google Play. Deleting the application does not cancel a subscription.

Where paid services are available, pricing and billing conditions will be displayed before purchase.

Payments made through platforms such as Apple’s App Store or Google Play may also be subject to the applicable platform’s payment and subscription terms.

When you subscribe through the App Store, you buy from Apple, under the Apple Media Services Terms and Conditions. For customers in France and in most European countries, the seller is Apple Distribution International Ltd., which concludes the sale in its own name on behalf of the publisher; the licence to use FinGames is granted by the publisher.

Unless required otherwise by applicable law, subscription management, renewals, and cancellations may need to be performed through the platform where the subscription was purchased.

We reserve the right to modify pricing for future billing periods, subject to applicable notice requirements.

15FREE TRIALS AND PROMOTIONAL OFFERS

We may occasionally provide free trials, promotional access, discounts, or other offers.

FinGames does not currently offer a free trial. Access requires an active subscription from the outset.

Should such an offer be introduced, its scope, duration and conditions would be displayed on the subscription screen before it begins.

Eligibility requirements and duration may vary.

We reserve the right to modify or discontinue promotional offers subject to applicable law.

Unless cancelled before the end of a trial period, a trial may convert into a paid subscription where this has been clearly disclosed during registration.

Because subscriptions are sold by Apple, your right of withdrawal and any refund request are handled by Apple, under the Apple Media Services Terms and Conditions in force when you subscribe. For consumers in the European Union, those terms provide a right of withdrawal, exercised from the purchase history of your Apple Account.

This does not affect any mandatory right you hold under the law of your country of residence.

16SERVICE AVAILABILITY

We aim to keep FinGames available and operational.

However, we do not guarantee uninterrupted access.

The application may occasionally be unavailable due to:

• maintenance;
• technical issues;
• infrastructure failures;
• updates;
• security measures;
• circumstances outside our reasonable control.

We may also modify, discontinue, or replace features where necessary.

17UPDATES TO THE APPLICATION

We may release updates to improve:

• functionality;
• security;
• content;
• compatibility;
• design;
• performance.

Certain updates may be necessary for continued use of the application.

The availability of features may vary depending on device, operating system, geographic location, subscription level, or application version.

18DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, FinGames is provided on an “as is” and “as available” basis.

We do not guarantee that:

• the application will always be available;
• all content will be error-free;
• using FinGames will guarantee academic, professional, financial, or employment success;
• using FinGames will result in success in interviews, examinations, trading activities, or recruitment processes;
• any specific learning outcome will be achieved.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded under applicable consumer protection laws.

19LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, FinGames — Aaron ADA (EI) shall not be liable for indirect, incidental, consequential, special, or similar damages resulting from the use of or inability to use FinGames.

In particular, we are not responsible for losses resulting from financial, trading, investment, employment, academic, or professional decisions made on the basis of content accessed through FinGames.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

20PRIVACY

Your privacy is important to us.

Our collection and use of personal information are governed by our Privacy Policy, available within the application and at our website.

The Privacy Policy explains, among other things:

• what information we collect;
• why we collect it;
• how it is used;
• how long it may be retained;
• what rights users may have regarding their personal information.

By using FinGames, you acknowledge that you have had the opportunity to review our Privacy Policy.

21ACCOUNT TERMINATION

You may stop using FinGames at any time.

Where account deletion functionality is available, you may request deletion of your account through the application or by contacting fingames.support@gmail.com.

We may suspend, restrict, or terminate access where reasonably necessary, including in cases of:

• serious or repeated violations of these Terms;
• fraudulent activity;
• manipulation of application systems;
• security risks;
• unlawful activity.

Where required by applicable law, appropriate notice will be provided.

22CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect:

• changes to FinGames;
• new features;
• changes in applicable law;
• security requirements;
• business or operational changes.

The latest version will display an updated “Last updated” date.

Where a change materially affects your rights or obligations, we may provide additional notice where required.

Continued use of FinGames after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.

23GOVERNING LAW

These Terms shall be governed by the laws of France, without prejudice to any mandatory consumer protection rights available to you under the laws applicable in your country of residence.

Any disputes relating to these Terms shall be handled by the competent courts determined under applicable law.

If you are a consumer and a dispute with us has not been resolved after you have written to us, you may refer it free of charge to the following consumer mediator: being designated; its name and website will be published here — meanwhile, write to fingames.support@gmail.com.

24SEVERABILITY

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

25ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any additional terms expressly presented for specific services, constitute the agreement between you and us regarding your use of FinGames.
